1. Acceptance of Terms

By creating an account or using Whisper+Me ("the Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use Whisper+Me. By registering, you confirm that you are 18 or older. We reserve the right to terminate accounts of users who misrepresent their age.

3. Safe Space Standards

Whisper+Me is built as an emotionally safe, judgment-free space. By using the Service you agree to:

• Treat all members with kindness and respect.
• Not harass, abuse, threaten, demean, or stalk other users.
• Not share sexually explicit content without explicit consent of all parties.
• Not impersonate any person or entity.
• Not engage in or solicit illegal activity of any kind.
• Not record calls without the consent of all parties (where applicable by law).
• Not use the platform for commercial solicitation not authorised by Whisper+Me.

Violation of these standards may result in immediate account termination.

4. Coin System & Payments

• Coins are a virtual currency used to access certain features. 1 coin costs $3.00 USD.
• Coins are non-refundable once purchased, except where required by law.
• Coins have no cash value and cannot be transferred between accounts.
• Whisper+Me is not responsible for calls that fail due to network conditions or user error.
• All payments are processed securely by Stripe. Whisper+Me does not store your card details.

5. Creator Earnings

• Members who receive calls earn $2.00 USD per coin spent by the caller.
• Whisper+Me retains $1.00 USD per coin as a platform fee.
• Earnings are paid out via Stripe Connect. You must complete Stripe's identity verification to receive payouts.
• Whisper+Me reserves the right to withhold earnings from accounts found to be fraudulent or in violation of these terms.
• You are solely responsible for reporting and paying any taxes on earnings.

6. Privacy & Calls

Calls are transmitted through Agora's RTC infrastructure. Whisper+Me does not record calls. Location data shared via the map feature is stored only while your location is active and deleted when you turn it off.

7. Disclaimers

The Service is provided "as is" without warranties of any kind. Whisper+Me does not guarantee call quality, availability, or uptime. We are not liable for any damages arising from use of the Service.

8. Termination

We reserve the right to suspend or terminate any account at any time for any reason, including violation of these terms. Users may delete their account by contacting support.

9. Changes to Terms

We may update these terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated terms.

Privacy Policy

1. Information We Collect

• Account data: email address, display name, profile photo, bio, social links.
• Usage data: call history (caller/receiver IDs, timestamps, coin amounts).
• Location data: latitude/longitude when you enable location sharing. Deleted immediately when you turn it off.
• Payment data: handled entirely by Stripe. We do not store card numbers.
• Chat messages: community chat messages are stored in Firebase and visible to all logged-in users.

2. How We Use Your Information

• To operate the call and coin system.
• To display your profile to other members.
• To process payouts via Stripe Connect.
• To detect and prevent fraud and abuse.

3. Location Data

Location is only collected when you explicitly enable it in the app. You can turn it off at any time from your profile settings. Location data is not shared with third parties beyond what is necessary to display the live map feature.

4. Data Sharing

• Agora: voice call data passes through Agora's RTC servers. See Agora's Privacy Policy.
• Stripe: payment and payout data. See Stripe's Privacy Policy.
• Firebase (Google): database, authentication, and storage. See Firebase Privacy.
• We do not sell your personal data to third parties.

5. Data Retention

Account data is retained until you request deletion. Call records are retained for up to 90 days for fraud prevention. Chat messages may be retained indefinitely as part of the community log.

6. Your Rights

Depending on your jurisdiction you may have the right to access, correct, or delete your personal data. Contact us at whisper.me.support@gmail.com to exercise these rights.

7. Children

Whisper+Me is not intended for users under 18. We do not knowingly collect data from minors. If you believe a minor has created an account, contact us immediately.

8. Security

We use Firebase Security Rules, server-side token verification, and Stripe's PCI-compliant infrastructure to protect your data. No system is 100% secure; use the Service at your own risk.
